'PPP' is proved to be an effective approach for solving problemsexisting in country's public utilities, by many countries in the world.However, because of the differences among opinions of individuals andpractices of countries, etc, 'PPP' are operated in quite different forms allover the world. In our country, it is still new to the public. The researchersin 'PPP' are centralized, and the contents of 'PPP' research are limited.This paper discusses the definition, legal character, and classification of'PPP', by consulting a plenty of internal and external books and papers,pursuing the origin of 'PPP', and comparing some authoritativeviewpoints and practices of countries. In the broad sense, 'PPP' includesall the arrangements of the privates affording public products and services.But in the narrow sense, it only refers to the pattems that the govemmentsand privates sign a series of contracts to define both duties and rights andgrant privates concession to afford public products and services, and bothparties share the risk and benefits. 'PPP' can be divided as a lot of types,including 'BOT', 'TOT', 'LBO', etc, which have one commonness thatthe arranger is the governments, and the producer is the privates, theconsumers bears cost, and the privates takes toll from the consumersaccording to the concession. Besides, this paper suggests a legal frame of'PPP', which is led by constitution law, and focuses on the concessionlaw in public utilities, supplemented by sole project legislation, andassorts with local legislation, corporation law, profession law, and otherregulations, guided by other standardized files as well. This paper alsodiscusses three specific problems of 'PPP' law enacting: applicable extentof 'PPP', the institute for overseeing, and the nature of concessionagreement, in order to develop 'PPP' lawmaking. This paper aims atabsorbing more attentions upon 'PPP'.
