The right of privilege issue from Roman law. French Civil Law and Japanese Civil Law and so on have systematic provision about the right of privilege, but German Civil Law and Switzerland Civil Law and so on haven't the similar provision. The right of privilege is not independently substantive right instead of discharge order of special creditor. The right of privilege is against to legislative value of modem security interest laws and property right publicity of property laws.There isn't systematic provision of privilege in Chinese civil law. It is unnecessary to prescribe the right of privilege in Chinese Civil Law, not only because of the nature and the limitation of privilege, but also the succeed of laws and existing provision or legal theory. In order to protect special interest, we can perfect special civil law or security interest such as legal hypothec and lien.
