Study On The Basic Theory Of Public Reliance From Immovable Property Registration

The public reliance from immovable property registration is of characteristic oftheory and practice. In this article,we research the fundamental problems as follow:the quality, the rationality of existence, the content of reliance and the relation withrelevance systems of the public reliance from immovable property registration.These problems have close connections, and form the basic theory of the publicreliance from immovable property registration. The author think the public reliancefrom immovable property registration is a principle for the security oftransaction. And its rationality is rooted in the property order of security- orientedand the construction of such property order has its deep basis of epistemology andaxiology. The public reliance of registration book includestwo parts: who rely on the registration book and which part is of worthy ofreliance.The author think the third party of goodwill is the person of reliance, andthe records about real rights is the object of reliance. The bone fide acquisition ofimmovable property is the concretization of the public reliance from immovableproperty registration. And the abstraction of juristic act of real right has greatdeficiencies when comparing with the public reliance from immovable propertyregistration.
