Research On The Administrative Power Of Trade Association

The rise and development of social media organization in the last century was one of the greatest achievements in the development of society and political reform. As the important part of the social media organization, the trade association, of course, gets a good chance of development. So many researchers do a lot of research work in the development of trade association in the region of economics,sociology science. The research work of law science in the region is far to the needs.This article is a revolution of research on the administrative power of the trade association. The research in this paper is based on the theory of economic law, and the conditions of trade association in China. The paper analyses the basic theory of trade association, administrative power of trade association, management system, and so on, which are key problems of trade association. Because this paper believes that lack of administrative power of trade association is the basic reason which the functions of trade association can not normally display.This paper is divided into five parts.The first part, writer research the connotation and extension of modern trade associations, based on study of characteristics and classification of trade association.This part regards trade association as the legal subject of Economic Law. Trade association supports a new society mediation mechanism for Economic Law.The second part does a detailed discussion on the administrative power of trade association. On the basis of analysis on origin of the administrative power, the part studies characters of the administrative power. And this part does a does a detailed discussion on the 12 kinds of the administrative power, which are very important to the development of trade association, and which constitute the basic range of the administrative power. This part does a detailed discussion on the exact manifestation of the administrative power under the Constitution Law finally.The third part research the managerial system of trade association what distributes between the executive powers of the government and the administrative power of trade associations. This paper compares typical foreign trade association management system patterns and our country's exploration, and Chinese trade association management system should take examples by this experience. The fourth part points out some questions which our trade association exist, and analyzes reasons to this questions.The fifth part points out if the administrative power of our trade association must be realized effectively, we must work a long time diligently from several aspects: cultivate the external environment of trade association cultivation; build trade association laws and regulations system; construct interior mechanism of trade association; and redesign the trade association management system .
