The rapid development of Internet in the 20th century has brought us all human beings great opportunities; as meanwhile a lot of problems—one is the spreading of unfair competitions in cyberspace. Because of its worldwide spreading, it's more difficult to be regulated. As we know, America has the most systematical legal system in the world, so we can draw a lot of experiences and lessons from its practices in this field. Therefore, this thesis starts with presenting the situations and features of online unfair competition practices in America; then analyzes the characteristics of America's legal system of anti unfair competition in cyberspace; in the end, with consideration to the related situations in China, gives some advices to the perfection of the legal system of anti unfair competition in cyberspace in China.The thesis is structured as following: first, forewords; second, introduction to the situations and features of cyberspace unfair competition practices; third, analysis of America's legal system of anti unfair competition in cyberspace, from both the perspective of legal acts and the perspective of judges' sentences in legal cases; fourth, advices to perfect the legal system of anti unfair competition in cyberspace in China through analyzing what experiences we can draw from America's practice; last, conclusion.Hopefully the thesis can make some contributions to the establishment of China's legal system of anti unfair competition in cyberspace.
