| The history that Human beings creates their folklores has been last for thousands of years, but the topic of using legal methods to protect folklores is just dated from the fiftieths of twenty century, It is because folklores have many peculiar characters so that until now whether inside or outside our country, opinions about folklore are far from unity, such as what is the concept and connotation of folklore? to use which legal protection mode to protect folklore is much better? Nowadays, we also haven't any authorized law to protect folklores, for a such country who is in rich of folklore, it will lead a great loss. So in this essay I will try to research the legal protection mode for folklore, and put forward to my point of view about some related problems.This essay includes four parts, In the first part I will discuss how to define folklore, and then introduce where is the word "folklore" come from, meanwhile I will put forward to some idea of mine. In the second part, I will introduce some legal protection mode for folklore, and discuss their different mode of law by means of developing countries and developed countries. The third part I will research what law mode is suitable for our country, In order to expound it, I will first introduce the current situation of using legal methods to protect folklore, and explain it by means of legislation and administration, and then discuss the obstacles of using copyright to protect folklore. Finally I will make a feasible analysis about the legal mode of protecting folklore-to put it in the system of intellectual property rights and make it a single-handed legislation. The forth part is building the legal system for protecting folklore of our country, I will analysis some related legal problems, and bring forwards to my suggestions about the legislation.
