The Investigation Report On The Execution Of The People's Attending System In Lanzhou People's Courts

The People's Attending System is an important judiciary, which is of great significance on the execution of judicial democracy and the promotion of judicial justness. On August 18, 2004, Standing Committee of People's Congress Council issued The Act on Consummating of System of people's Juror. On December 19, 2004, The Supreme People's Court and Judiciary issued The Supreme People's Court and Judiciary on the Empanel, Training, and Merit the People's Attending System. On January 6, 2005, The Supreme People's Court issued The Supreme People's Court on the Management of the People's Attending System (try out). From then on, the People's Attending System has stepped into a new stage. And the new People's Attending System began to be implemented on May 1, 2005. By now, it has been carried out for over one year. But in practice, we should pay attention to how the execution of the People's Attending System is, what achievements it has achieved, and which questions should be improved.With these questions in mind, the author made a survey study on the execution of the People's Attending System in Lanzhou People's Court, got the first-hand materials, and found out the existent questions. The present paper can be divided into three parts.The first part is an introduction of the execution of the People's Attending System in Lanzhou People's Court, involving the empanel of the people's juror in Lanzhou elementary people's court, the particular explanation of the juror's number, distribution of vocation, age, and education of the people's juror, and their training, management, and participation in cases cognizance of the people's juror, and so on.The second part descries the existent questions of the execution of the People's Attending System, involving the empanel of the people's juror, the requirement of the juror's number, the no guarantee of the outlay of the system of people's, the disorder of the management, and the less participation in cases cognizance of the people's juror.The third part puts forward the suggestions for the improvement of the People's Attending System according to the analysis of the existent questions. We should strengthen the propaganda of the people's juror, select scientifically them, train properly them, manage and employ scientifically them, assess and honor scientifically them, man oeuvre their enthusiasm, and so on.
