The essay will also cover the present situation and existing problems of intellectual property as investment.Chapter 2, study the evaluation of intellectual property , analyze the existing problems in the evaluation of intellectual property from the angles of economics and law. and approaches some legal factors which might influence the evaluation of patents, trade-mark, copyright. it explores the combination of the two sides in order to do some contribution to the intellectual property evaluation of China.Chapter 3, it analyze the legal issues of intellectual property as investment, from views of legal procedure of intellectual property as investment, illusion and prohibition of investment, performance and risk bearing of investment. How to avoid the risk of intellectual property as investment has also been discussed.Chapter 4, It takes different countries regulation on the risk of intellectual property as investment as reference and analyze the capital mode in old and new company law. It presents some suggestions on improving Chinese legislation and judicature of the intellectual property as investment.To sum up, Intellectual Property are effective areas for modern enterprise to improve competence and can also ensure state economy development and technology advance as an important legal system. Therefore, only a self-contained system of evaluation and supervision of Intellectual Property can encourage modern enterprises utilize Intellectual Property complying with request of knowledge economy in accord with sustainable development.
