The Research Of Supervision Legal System Of Internet-Bank

The application of the internet-technology in the field of bank in the 1990s triggered the internet—bank. As a new thing, the internet—bank developed quickly in the years that followed. Therefore, there are lots of unsolved questions. One of them is how to supervise the internet-bank according to the law.The internet—bank has unique features for the sake of the application of the internet technology and has incomparable advantages. At the same time, it also brings new risk and challenges the bank supervision. The most difficult problem for the Bureau of Financial Supervision is how to alter or adjust the supervision system in order to set up the financial order. However, such topic has been little touched and there is no in depth and systemic discussion about it. Just with those considerations mentioned, this thesis studies the advanced experience of those countries and regions in order to make research on the way to constitute the legal system of the supervision of the internet—bank in China.The thesis consists of four parts as follows:The first part: The internet—bank and the challenge facing legal system of internet—bank supervision. It defines the concept and features of the internet bank, then analyses characteristics of the new risk and brings out the challenge facing legal system of internet—bank supervision. Finally, it points out the necessity of the supervision.The second part: The reviews of legal system of the supervision of the internet—bank of foreign countries and the reference to our country. It introduces the legal system of the supervision of the internet-bank in developed countries. Finally, it comes to several revelations about our country.The third part: The international supervision of the internet—bank. It introduces several articles about international supervision and the internet—bank supervision. Then it points out new recognition and prospect about the international supervision of the internet-bank.The fourth part: The perfection of the strategy of the supervision of the internet—bank in China. It points out existing questions and reasons in China. Using the successful experience of foreign countries for reference, it assumes the perfection in China.
