In company with commoditization of house and increase of private car, the ownership of parking space in property region became the attention-getting hotspot. In a long time, the ownership of parking space is in confusion, arousing endless dissension. The insufficient research leads to the lack and weakness of legislation. The Real Laws is anxious and partial to the actuality, as the local legislation goes improperly. This thesis is going to investigate the ownership of parking space, summing up the defect both in legislation and research, studying the relevant theory, the characteristics of real estate, the demand of national defense and condition of nation, defining the ownership of different types of parking space, and finally putting forward proposals of legislative modules.This thesis divides into three parts. The first part discusses and analyzes the current complexion of parking space ownership, which is in confusion due to the insufficiency both in legislation and study. The second part focuses on how to identify the ownership of parking space, indicating that it should be established on the condominium theory, also in accordance with the characteristics of real estate, under the guidance of the national defense demand, integrates the condition of nation, and take the legislation of other country (region) as reference. Base on the former two parts, the third part make a concrete analysis of the ownership of all kinds of parking space, and it comes the conclusion that the planning parking space should be in a state of intercommunity, other parking space should be in a state of exclusive ownership. Proposals of legislation, also, are brought forward.
