The Protection Of Consumer Rights And Interests In The Perspective Of Anti-Unfair Competition

Unfair competition refers to the behaviors which violate the principle of honesty andtrustworthiness in the industrial and commercial activities．Along with the rapid developmentof market economy and the deepening of competition,the unfair competition is becomingmore and more serious．The Law against Unfair Competition is to prevent and restrict unfaircompetition,and to protect the rights and interests of consumers,which is an important part ofthe Consumer Protection Law．Therefore,discussing the protection of consumer rights andinterests in the perspective of anti-unfair competition,is becoming more and more important．This thesis starts with the relevance between unfair competition and the protection ofconsumer rights and interests,illustrates respectively some related concepts and new trends ofunfair competition,and shows the encroach of unfair competition on the consumer rights andinterests．Then,this thesis expounds the necessity,possibility,and inevitability of theprotection of consumer rights and interests with the Law against Unfair Competition,illustrates the characters of the Law against Unfair Competition,and disserts that theprotection of consumer rights and interests is the ultimate goal of the Law against UnfairCompetition．After the settlement of the legal principal of the protection of consumer rightsand interests with the Law against Unfair Competition there comes the problem of therelationship between Law against Unfair Competition and Law on the Protection of the Rightsand Interests of Consumers and the applicability of the former on the latter in the protection ofthe rights and interests of consumers．Through the detailed comparison of the two law,thethesis points out that they are concordant,mutually supplementary,and mutual supportive．Ifthere are problems related with unfair competition in the process of providing supplementaryprotection of the rights and interest of consumers,we should adhere to the principle of priorapplicability of the Law against Unfair Competition and supplementary applicability of theLaw on the Protection of the Rights and Interests of Consumers,and maintain the standard ofbeing beneficial to the consumers．Finally,focusing on the real status of the protection ofconsumer rights and interests with the Law against Unfair Competition in P．R．C,learningfrom the relevant provision of other countries and the international convention,the thesis putsforward some preliminary proposition on perfecting the system of the protection of consumerrights and interests in the Law against Unfair Competition,and states some opinions andsuggestions from the legislation,enforcement of law,and the administration of justice．...
