The Thought Of Perfection Of Legislation On Nature Reserves

Along with the development of human society and theadvancement of science and technology, environmental crisisbecomes more and more prominent. Ecosystem degradation, lossof biodiversity has become a major global ecological andenvironmental problem. This is acknowledged to be a majorthreat to sustainable development of mankind. Therefore,nature reserves are particularly highlighted the importance asmeans of protecting the natural environment and biodiversity.Protection of typical natural ecosystems, rare and endangeredspecies and improvement the development of nature reservesthemselves starts to gain a great deal of attention by theinternational communities.In recent years, our country nature protection areaobtained the fast development and formed the nature reservesystem of more reasonable layout and comprehensive types. Butthe legislation in China on nature reserve does not correspondwith the rapid development of nature reserves. It has not yetestablished some important rules and laws, and the concept onlegislation has been a little bit backward and difficult toadapt to the requirements of the new situation of China's naturereserves legislation. Therefore, the urgent task on the present building of nature reserve is to set up the appropriate legalsystem that suits the specific condition of China's naturereserves. Beginning with the current development of NatureReserve in China and its related legal system, this thesisattempts to analyze and evaluate the related legal system, andat the same time make some suggestions to improve thelegislation on Nature Reserve on the basis of the advancedexperience of foreign countries. The thesis is composed of fourparts: the first part introduces the definition,characteristic, role as well as significance of Nature Reserve,and illustrates the necessity of strengthening the legislationabout Nature Reserve in China; the second part analyzes thelegal protection on Nature Reserve abroad and its enlightenmentto the legislation of our country; part three explains thecurrent situation of nature reserve in China as well as itsproblems; with reference to "Nature Reserve Law" (Draft), thefourth part makes some specific suggestions to improve thelegislation on Nature Reserve in China.
