Study On The Related Problems Of Legal Protected Mode And Protective Range Of Computer Software

As a rising industry, computer software is very important to our economicadvance. Many countries have different points on the protected mode and theprotective range of computer software, and so on. The legislation and theory ofcomputer software are incomplete in our country, so we should pay more attention tothe protection of the intellectual property of computer software.The text has four parts.The first section is about the concept, characteristics and the primary protectedmodes of computer software. And the author suggests that computer software needspecial legislation.In the second section, the author discussed about the advantages anddisadvantages of copyright law, exclusive law and provision of trade secret. Thenthe author suggests that we should utilize the advantages and avoid thedisadvantages in our lawmaking.In the third section, it describes the protective range of computer software law.Because of the special character of computer software, the author suggests that weshould distinguish the difference character of copyright law, exclusive law andprovision of trade secret, to protect the idea and the expression of computersoftware.The last section is the suggestion about the legislation of our country. Theauthor points out the problems of our legislation and offers some proposes for thelegislation of computer software.
