Research On Legal Issues Related To Administration Planning

As an effective administrative tool,administration planning is widely used inpractice.It is an important part in the study of continental law system administrativelaw theory.Germany,Japan and China's Taiwan region have formed a theoreticalsystem in the research of administration planning.Common law system administrativelaw theory seldom studied administrative planning systematically.Because administration planning plays an increasingly important role in practice,China's administrativelaw scholars have started to pay attention to the study and discussion onadministrative planning.At present,the theoretical research on administration planninghas lagged behind in China,besides,administrative planning legislation is notperfect, consequently,the executive abuse of administrative planning andadministrative violations of the legitimate rights and interests of the administrativerelative happened frequently.In view of this,the author selected the problem for thisstudy.This essay,based on the analysis of the basic theory of administrativeplanning,especially the analysis on the nature of administration planning,and theobservation on the concept of administrative planning,primary body,scope ofapplication,procedures and legal relief in foreign and other parts of the world,offered some countermeasures to improve administration planning in administration planninglegislative model,the scope of application,the basic principles,procedures and legalrelief, which are aimed at the present state and problems of administrative planninglegislation.
