Research In Use Right Of Space

With the population explosion in the city and decrease of land resources, using land in stereoscopic form has become a general trend all over the world. Space right is a new right, which emerged when using of land developed from two-dimensional to stereoscopic form. Compared with the western countries, our country is left behind whether in the practice of using the land on stereoscopic form, or in the legislation of this aspect. By studying the theory of the civil law for spatial use rights and researching the existing legislative experience, this thesis makes clear the theoretical and practical basis of our systematic design. In the same time it also points out the mode of use right of construction land is the best choice fit to our reality. However, there still exists some problems, such as unclear property of use right of spatial construction land, improper design of use right in construction land and farm land and non-display of use right of spatial farm land. So it puts forward some measures like defining broad concept of use right of construction land to improve our system of space use.
