Study On Legal System Protection Of The National Development Right

Since the founding of new China, under the correct leadership of the party and the government, through the strong support, and the concerted efforts of people from all ethnic groups, ethnic regions have made tremendous achievements in economy and community. Minorities'production and living conditions have been substantially improved,the right of survive can be satisfied,with a certain capability of development. At present, on the background of further reform and opening up and the establishment of a market economy across the country in general, with the widening gap between developed regions and minority areas, a serious economy imbalance happened in regional economy development. Due to the differences in the level of development of the national productive forces, it leads to the unequal status in society and inequality in practice. Because of differences in economic development and social progress and the degree of realization of human rights, minorities wish to the equal opportunities and achieve common progress in the name of their own. Therefore, minorities and ethnic areas claim the right of development in order to catch up with the average development level of the country.Based on the basic theory of the development right, the paper is to define the scientific meaning and the nature of the national development right, prove the legal attributes of the nation's development right, and conceive the significance of the national development right for ethnic groups and regions. Through the investigation in Turpan City, using the method of anthropology, sociological case study, the author analyzes the factors to keep from realizing the national development rights in Trepan city. Finally, the author attempts to use all-round legal means, such as national legislature, the judiciary, law enforcement, legal supervision, and legal education and publicity, etc., to protect the national development right, which can prompt to realize the national development rights as soon as possible, promote the rapid development of national economy and the society and so that the nations can embark on an equal development and common prosperity, and push forward the early realization of a well-off society in the country. It is not only the main content of the scientific development concept and a harmonious society, but also it proposes new ideas that China community party handles ethnic relations in the new period: unity, harmony and development.Based on the combination of documents and social survey, the typical surveys and system analysis during the writing process, the paper is to analyze and demonstrate the factors to keep from realizing the national development rights. With the theoretical analysis and system innovation, the paper proposes the measures to protect the nation's legal system on development right, which is the focus and core of this paper.
