A Study On Public Hearing Of Administrative License Concerning Public Interests

Public hearing has been playing an important role since its legalization in Law of the People's Republic of China on Administrative Penalty in 1996. In Law of the People's Republic of China on Administrative License, passed by the congress and implemented in July 2004, further specifies the procedure and categories of pubic hearing of administrative license, and gives following ruling concerning administrative license of pubic interests (including environment pollution, land acquisition and use, large-scale construction projects etc. ):"or any other licensing matters of great importance to the public interests that the administrative organ considers it necessary to hold a hearing, the administrative organ shall announce it to the public and hold a hearing."This ruling calls for the administration organ to initiate public hearing on such public interests involved projects—a great improvement and advancement in our country's legal system.This thesis gives an detailed analysis of public hearing of administrative license involving public interests, and presents a theoretic study on such hearings'definition, connotation, sphere, host, participants ,effect of recording etc. The analysis and study in the thesis will advance the practicing of public hearing of public interests-involved administrative license.
