Humanity's counter-corruption practice tell us: Increases the attack dynamics has the effect in the certain degree to the duty crime which lightens and reduce and frightens, Actually is unable fundamentally to perform to control. Omni-directionally and multi- angles crime prevention based on the punishment, is the permanent cure road of punishing the duty crime. The procuratorial agency takes the national special law surveillance institution, not only shoulders the function of investigating and dealing with the duty crime, but also the duty crime prevention work which based on the legal surveillance function is also particular with the superiority, has already obtained the preliminary result, obtained society's widespread approval. But there is no doubts that duty crime prevention work in recent years exist some questions ,such as legal basis question, prevention measure, legal effect and so on. These questions cores lie in, the procuratorial agency develops in the prevention duty crime by no means within the job duty the work. These questions actually affect the depth, the breadth and the effect of the prevention duty crime work which developed by the procuratorial agency. So, the procuratorial agency must and have the necessity to strengthen the duty crime work research. This article carries on the elaboration and the research from four aspects to this question. The first part elaborated the duty crime concept and the basic classification; the second part elaborated the duty crime main characteristic and reason; the third part elaborated the theory and the practice basis of the duty crime prevention by the procuratorial agency ;the fourth part elaborated the authority conception of the duty crime prevention by the procuratorial agency.
