Reach On Several Difficult Questions Of Larceny

Based on researches in the past, this present dissertation is intended to conduct a thorough research on the basic theories of larceny. The contents of this dissertation are as follows:The subject of a crime is not only natural person, but also organization whatsoever. In my opinion, we can resolve this problem by emending law. I also make great efforts to differentiate between detinue and usurpation, when I research the problem of criminal intent of larceny. This dissertation makes a detailed study of the patterns of larceny, which is one of the complex issues of the study of larceny. Criminal object is another important side of crimine, and scholars of our country have dispute over this issue. As to the problem of death penalty application, I think it is necessary to retain death penalty now in China,and yet it is even more necessary to limit death penalty at present.
