As China joined the international convention of human rights protection and the jails are making progress in ruling the jails by law, the jails have attached great importance to the protection of the rights of the prisoners and made great achievements wherein. The author illustrates his opinions on the protection of prisoners' rights, in three parts.Part one deals with "Ruling by Law" and prisoners' rights. Ruling by law in prisons is an important part in the progress of ruling by law in China. The protection of prisoners' rights is the basis of both strict legal administration in jail and the realization of justice and fairness. The author illustrates the prisoner's rights and the present situation of protecting prisoner' rights.Part two deals with the conflicts between the protections of the prisoners' rights and the practice. The conflicts include conflicts with jail structure and jail carry-out system, conflicts with present criminal penalty system, and conflicts with ideas for punishing criminals.In part three, the author illustrates his opinions on protecting the prisoners' rights. The author argues that the protection should start from the perfection of related laws and the construction of the joint work of related legislation, judicial system, and administrative authorities. At the same time, the author expresses his critical views towards the situation of our protection of prisoners' rights and hopes it will help the progress in this respect.
