The system of forbidden to do the same business has been a legal measure to protect commerial secrets in western developed country,which has been used popularly by the emplory. It is an important legal system in nations to coordinate and balance the interests between the business parties,and to obstruct the unruly competition. With the development of the market-oriented economy, the areas it can be used is increasing. Now it has become an important regulation in Civil Law.At present most nations have admitted the legality of promissory prohibition of business strife. Based on the agreement, reasonable restriction in time, space and field should put on obligators. Legislation on compensation and compensation standard are needed. But, our country unexpectedly industry prohibition system construction and the fundamental research still were at the start stage. Therefore, the author wishes to provoke the interests of the jurisprudential circle through this thesis, and hopes the non-competing system can be operated standardized in China soon.
