Research On The System Of Judicial Relief About The Right To Education

The right to education is citizens'constitutional right and it is also a legal right confirmed by educational law. When this right is infringed upon , judicial relief is the most important way to ensure its realization. On the one hand we may realize the judicial relief about the right to education through administrative lawsuit , civil action and even constitutional lawsuit; On the other hand, we must distinguish the right to education owed double properties. As for the liberal right, the right may be given more sufficient judicial relief; As for the social right, the judicature should differentiate the compulsory education stage and the non-compulsory education stage to give the relief of various degrees .
