Studies On Administrative Planning And Legal Regulation Of It

Administrative Planning is one of the important administrative measures. How to make it work on the way of the law ruling has become an important issue of administrative law theory. This paper is a full exposition of it.This paper is divided into three main parts. The first part talked about the basic theory of administrative planning. It defined the connotation and denotation of administrative planning. It also made detailed analysis of the features and natures of administrative planning.The second part is on the control of law on Administrative Planning. It discussed the necessity and feasibility of the legal control, and defined the scope of administrative planning, which should be controlled by the law. Its own characteristics of Administrative planning determined the limits of the control of substantive laws and the superiority of the control of procedural laws. On a basis of survey of the successful experiences in other countries and regions,as well as the current situation in our country,it finally puts forward some tentative thoughts to make perfect administrative planning procedure legislation in China.The third part is on the judicial review of administrative planning. There are two main ways of judicial review. One is the review on the verdict of confirming administrative planning. The other is the review on the changing and the ceasing of administrative planning. Make sure whether Administrative Planning has the possibility of the administrative lawsuit. It is the basis of judicial review on Administrative Planning.The comparative analysis method,the logic-analysis method,the value-analysis method and positive-analysis method are the main methods in this paper.
