On The Right Of Knowing Environmental Information

The Right of knowing environmental information is a newly emerging legal right. In the middle of the 20th century, with the world-wide ecological degradation, environmental issues have become increasingly prominent. The Environmental Rights of citizens in the international community have been gradually established. Almost at the same time, while the voices of Right of Peoples spread throughout the world, citizen's Right to Know about the Environment has become a fundamental right. The process of the cross-cutting and integration of the Environment Right and the Knowing Right is just the process of the establishment and improvement of the Right of knowing environmental information. However, in our country, the Right of knowing environmental information has not been formally established owning to the slow development of the law in this regard. Research on the issue of the Right of knowing environmental information in our country have conducted a related exploration and has achieved many results. Under the condition of the deep theoretical study in environmental protection and the new change of China's legislative and administrative practice, we need to study the theory further in-depth and make necessary amendments and perfection in practice. The formal establishment and perfection of the Right of knowing environmental information will be benefit.This paper is divided into three parts: the Introduction part, the Main part and the Conclusion part.The Introduction part is a brief description of the status and the significance of researching the Right of knowing environmental information.The Main part consists of four chapters. Chapter I is the basis for the theory. The author expounded on the origins', the meanings and natures of the basic background of the Right of Environment, the Right to know and the Right of knowing environmental information respectively. Chapter II proofs of the value of the Right of knowing environmental information. The author divides it into two aspects: the social value and the legal values. Chapter III introduces the comparison of the foreign legal system with Chinese legal system. Chapter IV explicates the perfection of t social. First the author gives a comprehensive analysis of the feasibility. Then bring out 6 ideas on the perfection of the Right of knowing environmental information.In the Conclusion part, the author stresses the academic research inadequate on the Right of knowing environmental information. The author talks about that administrative and legislative emphasis has to be raised further. The author hopes that through this paper the theory and practice of the Right of knowing environmental information can arouse the attention of more and more people.
