The Research On The Cost Of Law Enforcement In The Context Of Law And Economics

The thesis attempts to do a theory study on the cost of law enforcement from the angle of law and economics. The concrete angles are four classical theories of law and economics, namely Hand Formula, Nash Equilibrium, Coase Theorem and Posner Theory. The basic train of thought is to explore the ways of making the cost of law enforcement rational under the corresponding backgrounds through the research on the related questions about the cost of law enforcement under the four theories above.In the context of Hand Formula, the thesis points out that the administration should respectively add the essential cost, maintain the balanced cost or reduce the needless cost through the research on the related questions about the cost of law enforcement under the three hypotheses that the prevention cost is under, equal or above the product of accident probability and the loss.In the context of Nash Equilibrium, the thesis points out that the administration should respectively withdraw from the law enforcement domains in which the self-discipline organizations are autonomous, strengthen the law enforcement in important administration domains or develop a close cooperation between the administration and administrative relative persons through the research on the related questions about the cost of law enforcement under the different games between the administration and administrative relative persons.In the context of Coase Theorem, the thesis points out that the administration should respectively design and perfect the law system, confine and allocate the power of law enforcement, construct and innovate the system of law enforcement through the research on the related questions about the cost of law enforcement under conditions of Coase Theorem I andâ…¡.In the context of Posner Theory, the thesis points out that the administration should respectively ensure the correct orientation of subject of law enforcement, make the best use of the resources of law enforcement, choose the best way of law enforcement and improve continuously the efficiency of law enforcement through the research on the related questions about the cost of law enforcement under the concepts of rational maximizer, the law of demand, utility maximum and voluntary exchange.
