Study On Enforcement And Improvement Of Simplified Civil Litigation Procedure

It is widely recognized, by Chinese legal theorists and courts when facing the increasing civil actions in number, the high cost of and various types of civil litigations, that simplified civil litigation procedure has advantages to which are worth paying attention, among which mainly are a faster resolution of the case and reduced expense. In china, as the existing simplified civil litigation procedure could not satisfy the demand for judicial practice, not only legal theorists but also courts try their best to make simplified civil litigation procedure improved. Author tries to analyzes and surveys china's existing simplified civil litigation procedure in comparison with those in foreign countries, then put forward some suggestions for ongoing simplified civil litigation procedure improvement and reform in china on the basis of doing research work on juridical practice of civil law.There are four parts in my paper. The first chapter is to discuss the value and function of simplified civil litigation procedure, the second chapter is to survey the evolution history of Chinese simplified civil litigation procedure and other country or area's legislation and enforcement of simplified civil litigation procedure, the third one is to analyze problems about the enforcement of the existing simplified civil litigation procedure , the last one is to put forward some suggestions for ongoing simplified civil litigation procedure improvement and reform in China.
