Discussion On Establishment Of Institutions Of Expert Evidence In Our Country

With the development of the society, divisions of social labor become more and more specific, and every aspects of social lives have much to do with advancing of science technology. That is why in more and more cases especially civil and commercial cases the judges will be facing some particular attestation difficulties, which cannot be settled down by judges who cannot freely apply many special technologies and technology measures with legal knowledge alone. The above reasons can be used as explanations for worldwide tendency of the reference to science technology and special knowledge for obtaining evidence in judicial practice.Based on the comparative study on analyzing the institutions of expert witness (connotations, characteristics, peculiarities and concerning institutions, etc.)of the British-American legal systems and defects of current institutions of expert conclusion of our country, the article explains why our current identifier institutions cannot be used as an omnipotent instruments to settle down all special problems in judicial practice. Thus the reference significance of the institutions of expert witness emerges. Besides, the author explains the necessity and feasibility of establishment of instruments of expert evidence in our country by illustrating the current application and arguing of expert evidence in theory and in practice of our country. Finally, the author gives suggestions on establishment of identifier institutions and institutions of expert evidence in parallel in our country.
