Sterility, a disease of long standing is now finding solutions with the development of the technology of assisted procreate. However, assisted procreate is a double-edged sword as many other contemporary technologies, which may also give rise to some problems in relation to social, ethical, and legislative matters. As is proved, only by using regulations of law can we have such a medical technology better serve the humanity. Therefore, relevant law stipulations have been consecutively made in many countries in this regard, providing definite answers to some of the problems. Nevertheless, some heated debates about the multifarious issues resulted from the technology of assisted procreate will still continue for a long time to come.Taking the double perspectives of the human right to procreate and human physiological need to do so, this thesis starts by a discussion of the legislative and ethical basis of the technology of assisted procreate. Then, after providing an explanation of the different types and the consequences of such a technology, it analyzes the identification of parent-child relations resulted from the use of this technology and its differences with that of the natural relations decided by natural procreate. On the basis of such an analysis and discussion, the author proposes to call for legislative enactment as solutions to the controversies about such new technologies of assisted procreate as surrogate and cloning, as well as for the identification of parent-child relations thus resulted. In the conclusion, some principles of legislative regulations regarding assisted procreate are discussed and some suggestions are put forward.
