Abuse Of The Right Of Process And Discipline

Currently, the theory of protecting the right of process has attached importance toacademe. Whereas, the study of abuse of the Right of Process is slow and not developed,compared with the former, there is an imbalance between them. In this paper, the authoremphasized the importance of the studied for the abuse of the Right of Process, conceivesto build up the theory of it, tried to make it equal with the theory of protecting the Right ofProcess, made a research on the phenomenon of abuse of the right of process completely.This paper adopted the researching instrument both critical and case studying. The formerconstitutes the framework of research and main field to debate, the latter deepened thecritical study. This paper mostly studied the connotation and extension of the abuse of theRight of Civil Action, also, it claims transcend the idea of narrow scope of subject. It pointthat we will not only study the party who abuse the right of process, but also include otherparticipants of Civil Action. In addition, the paper system analysis the theory of discipline,and presents some advices.
