The Characte Ristics, Origins And Attacking And Precautioning Measurements Of China's(Quasi) Under World Crime

Thesis summary: This thesis commences from the underworld (character) differentiation of the built-up concept, the underworld character organization and the underworld organization in the criminological meaning. Through the analysis of the criminal law of our country's, the concept of the underworld crime has been defined in the 2 aspects-- the crime directly related to the underworld crime itself and the crime committed by the organized crime group.The characteristics of the underworld character crime has been generalized from the 4 aspects-- the organization structure, the economic power, the illegal protection and the society endangerment. The crime classification principle of the underworld (character) and the classification of the underworld character crime of different standards have been explained briefly. The development of the underworld crime in our country and their characteristics have been studied, thus the four changing trends—the underworld (character) crime towards the underworld convert, the control of economic realm and society, the infiltration in the political realm and the internationalized trend—have been exposed. The thesis mainly analyses the cause of the underworld crime from the following six aspects --the social and economic structure, the relative weakening of social supervision, the political corruption, the relative backwardness of legislation, the function of sub-culture, the infiltration of the foreign underworld organization. And it has also put forward and set up a prevention control system and an early-warning mechanism from the five aspects-- the macroscopic and microcosmic prevention, the cultural control, the penal legislation counterplan, the penal punishment and the countermeasure of education, etc.
