Research Of Secret Investigation

As the advancement of science and technology and the development of economy, the types, measures and forms of crimes are changing frequently, which showing intellective, organizational, professional, and having no distinct victims, no clear committing scenes, and having strong abilities to defend investigation. Other measures and forms of investigation are being developed and applied along with the change of the crimes. Being a kind of active measure, secret investigation has unique effect in investigating important, complicated and difficult cases, therefore, it is applied by most countries all of the world. However, secret investigation is close, opaque and difficult to be monitored and controlled, and in addition, there have no regulations about applying secret investigation in our laws, so, the actions of the spy department are not regular, and the efficiency of the secret investigation can' t be exerted completely and easily to be trespassed on the basal rights of the people. Based on the realities, it is necessary to legislate on the secret investigation. Here we entered the study on the basic issues of secret investigation, from seeing about the concept, studying the categorizations, the characters and the representations, the basic principles, and the histories of different countries. Furthermore, the efficacy of secret investigation is studied. And then, compared the models and characters of secret investigation with that of foreign countries' , analyzed the negative aftereffects and the causations, then, we put forward the proposal about setting up the legal system of secret investigation in China.
