A Research On Establishing Civil Public Welfare Lawsuit System In China

The economic development is bound to initiate legal progress. With the increasing influences on social public welfare by the socialization of economic development, public welfare lawsuit system has come into being and developed.This paper starts with the basic theories of civil public welfare lawsuit, briefly introduces the basic situation of civil public welfare lawsuit system in China, reveals the drawbacks of legal system of China in safeguarding social public welfare, and then elucidates the necessities and feasibilities to establish civil public welfare lawsuit system in China.On the basis of this, by exploring some basic factors in establishing civil public welfare lawsuit system such as the plaintiff qualification, the lawsuit range and the defendant responsibility bearing, this paper adopts empirical analyzing method and puts forward some concrete procedural designs and system conception for the legislative construction of civil public welfare lawsuit system in China.To establish civil public welfare lawsuit system in China, it is not only the need to comply with national and people conditions, to develop and perfect civil lawsuit legal system, but also the necessary need to construct legal socialism country.
