Protection Of Patient Privacy In Civil Law

With human civilization advance,they really realize,it is important that law protects thoughts, sensibilities and feelings,just like law protects material property .So human beings'privacy can not be controlled by human ,but it loads human beings'many thoughts ,sensibilities and feelings. If they trespass on privacy ,the result will not be forecasted .So theorists and practicers have bringed into discussion about privacy protection,such as gene privacy , network privacy, public person'privacy . Patients are weak in front of doctors and hospitals,but there is not enough attention about patient privacy in the world . Civil law emphasizes human beings'rights meticulously. So author will discuss about patient privacy'legal protection. The first part is introduction that it mainly introduces theoretic and practical significance about this problem. The second part probes into patient privacy'conception and content. from the etymologic aspect. It analyzes about privacy, patient , patient privacy . Its content includes four parts, witing right,secret right, dominative right, protective right . The third part is key part in this article. It mainly analyzes and discusses about legislative principle of patient privacy. Benefit harmonizing principle and priority of public interest principle are dominant principles. While priority of public interest principle is doubtful in the article. The fourth part is main part .It discusses about establishing civil jurisprudence. These legislative systems included scope , method , tort construct , relieves. The fifth part is finality which is to build up patient privacy'correlated systems , just like hospital managing institution. This can protect patient privacy much better.
