Research About Criminal Protection Of The Right Of Privacy

During the development of human history, people's concern about privacy is the fruit of civilization and progress of human society ,which reflects humanist care and coincides with the modern concept "people oriented". Since this century, it is common that people's privacy has been under threat in daily life due to rapid development and popularity of scientific advances and modern media techniques. That the criminal law, as the bottom line of social defense system, should pay attention to protecting citizens' privacy right is the key point of the thesis. However, the criminal law in China has not put the protection of the privacy right to a proper height. In view of legislation, the terms about protecting the privacy right are disorganized and lacks systematicness. Theoretically, experts of criminal law don't pay necessary attention to it so that people in China do not make themselves available of being really aware of the concept of the privacy right in criminal field.The thesis makes a profound analysis on concepts of privacy and privacy right and then proves the value and necessity of establishing systematic offense of impinging the privacy right from the following aspects: the world legislation trends, present criminal regulation in China and practical need. Based on it, the thesis put forward the legislation programs about privacy right in the criminal law, and make a brief analysis on components of offense of impinging privacy right and criminal punishment of it.
