Study On The Legislative Perfection Of Commercial Bribery Crime

Commercial bribery, with the rapid spread of economic development,is becoming a kind of the social cancer. Commercial bribery has such great social harm that has been pushed into the scope of criminal law.The regulations about commercial bribery in China Criminal Law includes: (163)crime of the staff in company or enterprises accepting bribes ;(164)the staff in company or enterprises executives crime of bribery;(183,1)the crime of staff in bank or other financial institutions accepting bribes,and other crimes scattering.The lack of system of regulations about commercial bribery crime causes the power of punish this kind of crime weak and unconcentrated.And the lag of relevant regulations has been proved in the judicial practice, seriously weakensing the effectively curbeding such crimes of criminal law.By the background of China signed "the United Nations Convention against Corruption", Based on the reality of our country and to the relevant international commercial bribery law,this paper Mainly study on the subject of commercial bribery, bribery, bribery profit Elements of the configuration and penalty ,then point out the defects of commercial bribery legislation,and try to give some propositions.
