Study On The Application Of Floating Charge In Shipbuilding Finance

The shipbuilding industry in our country have developed greatly, however, the development of shipbuilding financing is more behind the shipbuilding industry. In order to expend the shipbuilding financing channels, many countries in the world allow the mortgage of ships under construction. There are two modes for the mortgage of ships under construction. One is fixed charge, and the other one is floating charge. The author consider that the system designing of the latter is better than the former, and being suitable to the financing of large engineering item such as shipbuilding.This thesis mainly divides four parts to discuss above-mentioned standpoint. Firstly, it introduces relevant general provision about floating charge system. Secondly, the thesis introduces the way of shipbuilding financing and warranty of shipbuilding financing further, and combining with the current conditions of shipbuilding financing and practices in law, clarify that it is necessary and possible to apply floating charge to shipbuilding financing. Thirdly, on the basis of Property Law and combining with British Law which make up deficiency to Property Law, the thesis puts forward an applied concrete form of floating charge in shipbuilding financing, and specially discusses some tougher problems about mortgage registration such as the ownership relationship, the registering time and registering organization etc. Lastly, the thesis puts forward the protection measures for the morgagee's benefits in the aspects of law and practices.This thesis studies the application of floating charge in shipbuilding financing mainly by the methods of comparative and analysis, history contact, society inquisition and case analysis. The author kindly hopes that this thesis can provide some references for the resolving of the problem of shipbuilding financing by perfecting the relative laws.
