This paper analyzed As a social phenomenon, mendicancy exists in the world generally, it cause a series of discussion: whether mendicancy is a kind of human dignity, can the government interfere mendicancy (establish the district that forbid beg) etc..This text begin whit the purpose of the mendicancy , analysis of the causes of mendicancy,classifies the begging conduct. based on this to analysis the legal restrictions on begging behavior ,and make recommendations.That the current phenomenon of begging, showing a number of new features. First of all, the number of beggars are increasing; Secondly, more younger become beggars; third, there is variety of ways in begging Finally, the reasons that cause begging are different.Mendicancy is a personal freedom, in the form of rights; it is a kind of customary rights. If someone begs in order to achieve survival, it is legitimate. The state should not to intervene it. But freedom has its limits, when the begging behavior crosses the threshold, the laws of the country should be to interfere it, in order to protect others, the interests of the community.There are still certain lacks of China's current legal restrictions on begging .and we can learn from foreign experience, to formulation of the laws more rational and sound.
