On The Combination Mechanism Of Victim-Offender-Reconciliation System In The Application Of The Process Of Prosecution

This paper analyzed the system of the victim-offender -reconciliation, a solution to criminal cases which requires the judicial office to apply special mediations, kinds of restoring procedures to settle criminal cases to realize restorative results.The model of'big mediation of Nantong'determined by both the CPC's and Jiangsu's Politics and law Committee is one of the main ways to resolve social conflict. And the judicial office has explored and tried some systems connected to the'big mediation'in criminal cases. The author thinks that a research on the combination system of how to victim-offender -reconciliation in the procedure of Prosecution is positive to perfect the Criminal Conciliation.'The procuratorial mediation'is a system which requires the prosecution organs to merge into the'big mediation'system positively and take an effective advantage of the constitutes and resources integrated by the'big mediation'system to resolve all kinds of conflicts faced by the prosecution organs and the organs work for'big mediation'by combining the system design and the procedures, to promote the harmony among human beings and between human beings and society. The Procuratorates in Nantong has settled over 300 criminal cases with the system of'procuratorial mediation'from 2003 to 2006, which has exerted great influences on discarding the social conflicts and realizing the social harmony. Exploring the system theoretically and forming the operating methods into a legal system is practically important to construct a harmonious society.This article has designed the system of procuratorial mediation by analyzing victim-offender-reconciliation at home and abroad and researching the practice of'The procuratorial mediation'.
