In accordance with China's WTO accession commitments about opening financial and banking sector, the five-year transition period had expired on December 11 in 2006.The foreign banks have started a comprehensive intervention in China's banking market. In order to meet WTO commitments and adapt the new situation, China has promulgated and implemented the "Regulations of foreign banks" and "Implementation details about Regulation of foreign banks ".We have made a new system about market access supervision for foreign banks, which indicates that China's market access system for foreign banks to be further standardized and transparent and international. However, we also see that there are still some legal regulatory gaps and inadequate about market access for foreign banks under the new situation. In this paper, the writer will study and analyze the China's new market access supervision for foreign banks following four parts:Part I: the theoretical basis about the market access supervision for foreign banks, mainly introducing the legal definition about market access for foreign banks and analyzing why we should supervise the market access for foreign banks. Part II: the market access supervision for foreign banks under the international law system, mainly introducing and analyzing the market access supervision for foreign banks under the WTO system and the Basel system.Part III: the legal regulatory changes and legislative review about China's market access supervision for foreign banks under the new situation, mainly analyzing China's current market access supervision for foreign banks and its changes, we also analyzed the inadequate about China's current market access supervision for foreign banks.Part IV: studying how to improve China's market access supervision for foreign banks, mainly analyzing the legal objectives and the legislative basis choice about market access supervision for foreign banks, and then giving some specific legislative proposals to improve our market access supervision for foreign banks.
