The Research Of Tying-Arrangement In Anti-Monopoly Law

This paper analyzed the meaning and elements of tying arrangement, and then it discussed separate products, market power and restricting competition consequences. And it also analyzed different theories of the legality of tie-in. It further proved the reasons why tying arrangement is regulated in anti-monopoly law from three aspects.The second part compared regulations about tying arrangement of U.S, the EU, Japan, Korea and Taiwan region anti-monopoly law. And it analyzed several of the United States and the EU typical cases. It tried to sum up characteristics of tie-in legislature and the judiciary of various countries or regions.The last part focused on our status and anti-monopoly about tying-arrangement. Based on relevant provisions of Chinese anti-monopoly law, it discussed what attitude and position we should hold in consideration of national circumstances and our current situation. And finally the paper gave some proposals on how to improve the provisions of Chinese anti-monopoly about tying-arrangement and its enforcement.
