Research On The Protection Of The Rights Of Crime Victims

The government's efforts to protect the rights of crime victims are the demand of the times. To build a harmonious society is an important strategy in China. Social stability is a reflection of a harmonious society. Harmonious society respects human rights, advocates equal right, and protects rights of people fully. In 2004,"The state respects and protects human rights"was written into the Constitution. In 2007, the report in the Seventeenth National Congress of CPC pointed out that, the nation respects and protects the human rights, ensures the equal participation of all members of society, equality of the right to development. The rights of the suspects or the accused deserve to be respected and protected; the rights of victims of crime should also be respected and protected. In this paper, based on the various academic thinking, I raised my countermeasures on the protection of the rights of crime victims. In this paper, writing line in the main paper is: Summary of the crime victims– Foreign situation on the protection of the rights of the crime victims– the necessity of China to protect the rights of the crime victims - China's status quo on the protection of the rights of victims of crime– the countermeasures to strengthen our protection of the rights of crime victims. This paper composes introduction, body comments and conclusion.The first chapter discusses general the protection of the rights of victims. First of all, the paper researched the definition and the development of the victims in the criminal justice system. Then, the paper discussed on the characteristics of the crime victims as well as the types, and studied the abroad situation on protection of the rights of the crime victims. At the last, the paper analyses the necessity of China to protect the rights of victims. This is the need for the protection of human rights, the need of the criminal justice, and the need to prevent crime.The second chapter describes China's situation on protection of the rights of the crime victims. Now, China's crime victims were given a clear legal status at the parties."Criminal Procedure Law"as the basis for the article, I identified the rights in filing a case, investigation, initiation of public prosecution and trial stage. While affirming the achievements of the Criminal Procedure Law, I point out that the gap between the reality and the law is large, so we must try our best to improve the condition of the crime victims. Simultaneously, in China Community Corrections, the center of the existing Community Corrections is the criminals. And the Community Corrections lacks the interaction with the victim. So the victim basically does not have any status. Therefore, the present situation of protection on the victim's right is unoptimistic in our country.The third chapter analyses on the basis of the first and second chapter. My countermeasures to strengthen the protection of the rights of victims are to build national compensation system of the crime victims, improve the legal aid system, and practice the restorative justice.
