A Study On Protection Of Witness

A witness is the important participant in criminal activities, the witness'appearance in the court has an extraordinary significance. In fact, the serious situation of witness protection in judicial practice impedes the development of the witness protection system. So it is necessary to perfect the witness protection system which includes the comprehensive protection of personal safety, property and personality interests to change the present situation.This dissertation put forward a proposal for the necessity, procedure, measures of witness protection and for the protection of some special witnessThe first chapter analyzes the necessity and value of witness protection. It also emphasize on the value of protecting human rights protection, maintaining procedural justice and realizing social justice.The second chapter introduces the present situation of legislation and judicial justice in China's witness protection. It also analyzes the shortcomings of China's witness protection to disclose its roots.The third Chapter put forward the author's proposal for our country's witness protection. It respectively elaborates the contents and procedural constructions of China's witness protection system. It divides the witness protection system into three parts: personal safety protection, property protection and personality and spiritual interests. Besides, this dissertation analyzes some important issues in the construction of China's witness protection system, which include the threaten and infringement of public power, the impact of mass media to the witness protection and the responsibility of the witness leaking the secrets.The forth chapter analyzes and elaborates some kind of special witness protection which includes child witness, undercover witness, witness who have the rights to free permits and tainted witness.
