《Kyoto Protocol》and China New Industrialized Road

Since 1980's, international society has focused on the issue of global climatic change. The Governmental Negotiation Committee of the United Nations signed Framework Convention on Climate Change (FCCC) for the issue of global climatic change on May 5, 1992. At the meeting of Kyoto of 1997, the participating countries have reached Kyoto Protocol. The main content of Kyoto Protocol is decreasing the emission of six kinds of greenhouse gas, such as CO2 etc, it has become available on Feb 16, 2005.China signed Kyoto Protocol on May 29, 1998, and did not bear the decreasing mission at the first phase as a developing country, but China envisaged with serious double stress from home and overseas. At home, the total amount of greenhouse gas emission of China is the second largest in the world now. The future is not optimistic for the forecast that China will catch up with America at the emission of greenhouse gas in 2025. At overseas, one reason for America rejecting to sign Kyoto Protocol is China does not bear the mission of decreasing emission. Now the popular opinion is China should promise the mission of decreasing emission of greenhouse gas.Facing with the stress, what course should China do? The dissertation considers by analysis that the root of high amount of greenhouse gas emission of China is the traditional way of industrialization, which the main character are"high input","high emission"and"low efficiency". The traditional way of industrialization brings to China not only the high strength emission of greenhouse gas such as CO2, but also environmental pollution and energy crisis. It is a way of unsustainable development. Regarding with how to implement Kyoto Protocol efficiently, the dissertation makes a strategic conceive that China should take a new way of industrialization. For the law plays an important role on accelerating the pace of the new industrialized road, we must deal with the relations between law and new industrialized road properly under the background of managing state affairs legally and building law country. There is some shortages which restricting to accelerating the pace of the new industrialized road. Finally, regarding with how to accelerating the pace of the new industrialized road, the dissertation provides some significative suggestions on the integrity of China law system.
