Analyzing The Perfection Of China's Civil Agent System

The author first mentions China's Civil Status agent system, while affirming our legislative achievements while also pointing out the problems that exist; points out the differences and the similarities of the Two Law System from selecting the right,prineipal and the relationship with a third person,the obligations from the agency and non authorized agency and the termination of the agency .At the same time, although there is a considerable difference in the two system, the convergence in legal theory and legal system is the requirements of the world economic integration ,and it is an irreversible trend. Finally,the author suggests that the future of China's Civil Code should be raised on the choice of the Legislative style, the supplement and the improvement of(mainly the Common Law System of anonymous agency and the introduction of the agency of Estoppel) the contents the law;advocates that we should inherit the tradition of the Civil Law and introduce the appropriate content of the Common Law into the existing civil legislation,which establish a relatively complete civil agency system.
