The Main Problems In The Criminal Case About Damaging Drug Trafic

Drug has been one of the most prominent social problems in many countries, including china. UN lists the drug, AIDS and terrorism to be the most important man-made social effects of pollution on our globe. In china, punishment on drug crime is always the focal point of criminal judicial affairs. In these years, China has been doing a lot of effects on this issue and made remarkable achievements. However, many specific problems still exist in practice, some of which even directly affect the chastisement on drug crime and the efficacy of the prevention and elimination of the happening of drug crime. From 1980s, Ningxia Hui nationality Autonomous Region has been being one of the high-happening areas of drug crime. Taking what kind of and how to take punitive measure on drug crime is a hard task for Ningxia administrative and judicial branches. This thesis will try to analyze the characteristics and the trends of drug crime cases of a certain area through the surveys on drug crime in Ningxia. To aim directly at the exist main problems in arranging the drug crime cases, especially those concrete problems such as, the testimony of planting of the drug-plants, the drug retails, the jurisdiction of the drug crime cases, the motive and intent of the criminal suspects, the testification of the drug belonging, the use of the investigating testifications during the criminal procedure, the use of some special principle, the recognition of the division of accomplishment and attempt of drug transaction, the tangible evidence of the detectives and the punishment measuring, this thesis will thoroughly analyze the reasons of these problems mentioned before. At the end, the thesis will conclude the experiences on anti-drug and punishment on drug crime in order to effectively eliminating the happening of drug cases.
