Civil Responsibilities Of Real Estate Management Enterprise

This paper is mainly to have an analysis on the civil responsibilities of real estate management enterprise,scope of the nature ,type and the conflict on the civil responsibilities of real estate management, then to put forward some relevant suggestions and measures for revision accordingly ,and also the issues existed in the process of real estate management Whilst in the light of some basic legal issues arising in the market operations of real estate management in China.Part 1 is to introduce the connotation, basic type, legal status and scope of responsibility of real estate management enterprise. Part 2 has reviewed the origin and development of real estate management enterprise .To start with the right, obligation and responsibility analysis on the responsibility of real estate management enterprise, this paper suggests that the civil responsibility be on the basis of the right and obligation, be the result while disobeying the obligation and the obligation be the production of all the civil responsibility. From the term of civil responsibilities of real estate management enterprise in China and West, the part discusses the development on civil responsibilities of real estate management enterprise in China.Part 3 and part 4 have discussed the civil responsibility of real estate management enterprise from the Roman contract responsibility and tort responsibility. Part 5 has explained the civil responsibility of real estate management enterprise from the concurrence on the civil responsibility of real estate management enterprise. In the future , with the development on the law of real estate management enterprise, this concurrence appearance will change.In the end, the 6th part defines the application of civil responsibilities of real estate management enterprise. I think we confine the civil responsibility of real estate management enterprise to the enterprise's civil responsibility which apply to the corporation law and other real estate management enterprise regulations ,which is also civil law and contract law .
