The Study On Investigative Problem Of Computer Crime

Nowadays, computer crime is a new kind of crime following producing and applying the electronic computer, internet, and information technology .With the rapid development of economy , science and technology, computer is being used wider and wider, thus computer crimes in whole world is even more serious, and the harmfulness in society is greater and greater , influencing economic progress and people's lives. Therefore, investigative and hitting computer crime is an important task for policemen in every country. In order to deal with the high-technical and powerful concealment crimes, how to perfect the construction of investigative organization for improving the ability of attacking computer crimes and to cope with the cunning criminals in network is a key problem for investigative organ. The paper strives to put forward concrete suggestions and tentative plans based on detailed analyzing the problems of computer crimes in our country. After studying the investigative body, this department is faced with how to investigate computer crimes, that is, investigative mode. Computer crimes are different from traditional crimes. However, traditional investigative modes are still used in most computer cases. With the progress of computer technology and network, the traditional modes can't suit for the transformation, so we should improve it or even change it for a new perfect one. This paper believes that the key point in gradually building new investigative modes is to transform traditional idea. By continuously summing up different circumstance , we should try to find out the perfect investigative mode adapting to state of China. At last, this paper also discusses the problems in carrying out investigative measures in detail, because, of course, this is a very significant step, especially attach importance to the combination of ordinary investigative means and particular means.This paper tries to expound the construction of investigative organization, investigative mode and the measures in computer crime, and hopes that more specialists and scholars can pay close attention to the criminal procedure legislation related to computer crimes and attack the computer crimes efficiently.
