A Study On The Administrative Accountability System

Beginning from the crisis of SARS in 2003, the administrative accountability system has become the brilliant point of one new round of political reforms in China. In recent years, many officials have been asked responsibility which gained consentaneous praise from all the society. The Premier Wen Jiabao brought forward that the administrative accountability system should be built up and perfected to improve the executive force and public trust force of government in《government work report》in 2006. Therefore, a scientific and reasonable administrative accountability system is beneficial to realize democratic politics, social fairness and justice, administration by law, administration management system reform, efficient,honest and clean government and socialist political civilization.Administrative accountability system is a popular phrase in these years, but in contrast with public attention the relative research appears insufficient. So the establishment and implement of the administrative accountability system lack theoretical support. This essay tries to do some work on this question to some extent and put forward the author's own opinions.This essay adopts some analysis methods, for example, the positive analysis, comparative analysis, documentary analysis and normative analysis. The author thinks that structure the scientific and reasonable administrative accountability system firstly must define its concept clearly theoretically. The administrative accountability system refers to asking responsibility subjects assess governments at all levels and his duty and degree of performance of obligation that civil servant undertake and implement and require them undertake one of result of denying. The intension of administrative accountability system consists of subjects, objects, scope, procedure and results etc.It is generally considered that the administrative accountability theory originated from the western constitutional government, democratic politics and responsible government thoughts. The contract social theory, the principal -agent theory, the public affairs theory and the power control theory all provide theoretical basement for the administrative accountability system. In the author's opinions, the fundamental principles of administrative accountability system include four principles as followed: asking responsibility by law, unity of right and obligation, citizen efficient political participation and the equality principles. Besides, the author provides some references to China through studying all kinds of administrative accountability system abroad which involves : the recall mechanism of officials in American states and local governments, the administrative supervision assistant system in Swedish parliament, the rules of officials in Taiwan province and the principal officials accountability system of Hong Kong. On the basis, this essay does detailed analysis and profound discussion about the status, the current problems and the reasons of administrative accountability system in China. In the end, the author thinks following measures should be taken to perfect our administrative accountability system: constructing new administrative accountability culture in notions, perfecting legal regulations in practice, ultimately constituting a countrywide《administrative accountability law》and pushing forward the correlative system reform. Among these correlative systems, promoting the reform of cadre personnel and administration management system, setting up the democratic and scientific administrative policy-making mechanism, advancing open administration to ensure the citizens' right to know, constructing governmental achievement assessment mechanism and perfecting the remedy mechanism are emphasized especially.
