Study On The Exsistence, Abolishment And Improvement Of The Pawning Right

Although the Pawning Right is an old and unique law system in China, it was abolished because of many reasons after the foundation of The People's Republic Of China. The Pawning Right system is picked up from the history by people when the Property Right Law will be made right now, so the problem of whether the Pawning Right system should be remained or not gives rise to people's argument. It is a flaw of the Property Right Law published in 2007 that doesn't include the Pawning Right. On the current academic research on the Pawning Right, the abolition of the Pawning Right. Although the view justified, but did not deny the right to the Pawning Right the rationality of the existence of the system, the right to retain the Pawning Right has not been sufficient reasoning views fully. The writer deems that the Pawning Right system should be remained after critisizing the ideas of the scholars whoes opinion is that the Pawning Right should be abolished. At the same time I made the reservation the Pawning Right some new grounds. However, to admit that the Pawning Right system is not perfect, it need proper reform to adapt to the changed real situation. This article tries to improve the Pawning Right system in terms of its subject, object, registration and term.
