On The Implementation Of The Evidential Discovery System In Criminal Public Prosecution Case

In several years ,the Prosecutorial organs have done some reform on the Public Prosecution System with good effect ,such as : Main suit , Responsibility System of direct public prosecutor , Simplified Common Procedure .While which puzzled us is that, although the Evidential discovery system have been experienced in prosecuratorate and court in Beijing Shandong and so on . It still have not got significant effect with no more extension application. Where is the problem ? How to implement this system ? which is the the theme that will be discussed strongly in this paper. Firstly, the paper discusses the foundation of theory and systematic origination on the Criminal evidential discovery system. Secondly, in order to offer some effect consultation it compares with foreign Criminal evidential system .Thirdly, it deeply investigates the main effort on pretrial evidential discovery system in some domestic experimental unit . Also it analysis their achievement and lost . At last, adhering to my own work experience , I raise my own view about the implementation of our criminal evidential system.
